Your contract with us
When you input your registration details and click on the “login” icon, a contract between us (Inkspot WiFi Limited) and you is formed under which we will provide you with wireless access to the internet via our WiFi network (our “Network”) in return for your payment. The contract between us and you is subject to these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy. Our Acceptable Use Policy and our Privacy Policy are incorporated into these Terms and Conditions.
In these Terms and Conditions references to the “Services” mean connectivity to the internet using our Network, and references to our “Website” mean www.inkspotwifi.co.uk
Acceptance of Terms
By clicking on the “create account” icon you are agreeing to be bound by these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy. If you object to any of these Terms and Conditions or our Acceptable Use Policy or our Privacy Policy, you should not click on the “create account” icon and you should leave our Website immediately.
Before clicking on the “create account” icon you should ensure that you are able to obtain a signal to access our Network from the location at which you wish to use the Services. It is your responsibility to ensure that you are able to obtain this signal, and we are not responsible for any failure to access our Network or to use the Services which results from a signal not being available.
Inkspotwifi and their clients reserve the right to remove any users from their networks who are deemed to have behaved an an inappropriate manner in any way.
Minors
If you are under 18 you must obtain your parent or guardian’s permission before registering to use the Services, and your parent or guardian must click on the “create account” icon. By clicking on the “create account” icon your parent or guardian is agreeing to supervise and be responsible for your use of our Network and the Services and your compliance with these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy. We reserve the right to require your parent or guardian to provide us with written verifiable confirmation that they have given you permission to use our Network and the Services and that they acknowledge and agree that they are responsible for your use of our Network and the Services and your compliance with these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy.
Right to Cancel
You have the right to cancel the contract between us and you at any time before the expiry of a period of seven working days starting on the day following the day on which you click on the “create account” icon. If you wish to exercise your right to cancel, simply let us know by writing to us at Inkspot WiFi Limited, 3a Dublin Meuse, Edinburgh, EH3 6NW; or emailing us at support@inkspotwifi.co.uk or faxing us at 0131 558 1243. If you exercise your right to cancel and you have already made a payment to us, we will refund your payment.
Please note, however, that if you use the Services at any time before expiry of the cancellation period, you are agreeing to forfeit your right to cancel.
Your Account
Once your registration is complete and the contract between us and you has been formed:-
On our free networks you may use your account immediately.
On our complimentary networks you may use your account to redeem a voucher. The individual voucher detail determines the period of time during which you have the right to use the Services. Once you have redeemed a voucher you may use the Services during the period of time applicable to that voucher.
On our paid networks you may use your account to select and pay via Paypal for a payment package. The payment package which you select determines the period of time during which you have the right to use the Services. You can select and pay for further payment packages at any time. Please click here to see details of the payment packages which are currently available in your location. Please note that the payment packages available and the prices may change from time to time.Once you have selected and paid for a payment package you may use the Services during the period of time applicable to that payment package.
If you want to close your account and terminate your contract with us at any time, simply let us know by writing to us at Inkspot WiFi Limited, 3a Dublin Meuse, Edinburgh, EH3 6NW; or emailing us at support@inkspotwifi.co.uk or faxing us at 0131 558 1243.
Your Obligations
You agree that you will not use our Network or the Services for illegal purposes and will respect all applicable laws and regulations. You agree not to use our Network or the Services in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Network. You also agree not to compromise the security of our Network or attempt to gain access to secured areas or sensitive information.
You are responsible for configuring your IT, computer programs and platform in order to access the Services. You should use virus protection software.
Your Password
You are responsible for keeping your account information confidential at all times. If you permit anyone else to use the Services using your account, you are responsible for that person’s use of our Network and the Services and compliance with these Terms and Conditions, our Acceptable Use Policy and Privacy Policy.
Your Indemnity
You will indemnify us for any and all claims, expenses, liabilities, losses, damages and costs, including without limitation legal fees, incurred by us and arising from your use of the Services, our Network and/or our Website or any breach or suspected breach by you of these Terms and Conditions, our Acceptable Use Policy or our Privacy Policy or your violation of any law or the rights of any third party.
Suspension and Termination of Services
If we believe that you are in breach of these Terms and Conditions, our Acceptable Use Policy or our Privacy Policy, we may suspend or terminate your use of the Services, our Network and/or our Website at any time without giving you prior notice.
We will also cooperate fully with any law enforcement authorities or court orders requesting or directing us to disclose the identity of, or locate, any person breaching any of these Terms and Conditions, our Acceptable Use Policy or our Privacy Policy.
Modification
We reserve the right to modify any part of our Acceptable Use Policy or our Privacy Policy at any time without notice to you. Your continuing use of the Services will be deemed to be acceptance of such changes. We advise you to regularly review our Acceptable Use Policy and our Privacy Policy for any changes.
We reserve the right to modify any part of these Terms and Conditions at any time by notice to you. By continuing to use the Services after we give such notice you are deemed to accept such changes.
Disclaimers
To the fullest extent permitted by law, we make no representations or warranties, whether express or implied, relating to our Network, the Services, our Website or the content on our Website, including without limitation as to accuracy, reliability, compatibility, security, completeness or fitness for purpose.
We do not guarantee uninterrupted availability of our Website or our Network or the Services and cannot provide any guarantee that access to or use of our Website, our Network or the Services will be uninterrupted, reliable or error free or free from viruses or bugs. In particular, but without limitation, access to our Website or our Network or the Services may be interrupted for short periods whilst essential maintenance works and/or upgrades are carried out.
Without prejudice to the foregoing, we will not be liable for any failure of, or any suspension or termination of access to, the Services, our Network and/or our Website arising out of any circumstances beyond our reasonable control, including, without limitation, failure of infrastructure, government intervention, wars, civil commotion, hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist attacks, or industrial action affecting us or our suppliers.

We exclude, to the fullest extent permitted by law, liability for losses and damages suffered by you as a result of your use of the Services, our Network and/or our Website, whether such losses or damages are direct, indirect, special, or consequential, including, without limitation, any loss of business, revenue or profits or loss or damage to data, software or hardware.
Nothing within these Terms and Conditions operates to exclude or limit our liability for death or personal injury arising as a result of negligence, for fraud or fraudulent misrepresentation or for any other matter in respect of which it would be unlawful or illegal to exclude or limit our liability. All intellectual property (including without limitation copyrights, trademarks, trade names, patents and registered designs) in our Network (including without limitation its aesthetics and/or functionality) or our Website or any content on our Website remain the property of us or our licensors. You agree to respect the intellectual property rights of us and our licensors and not to do anything to infringe such rights. In particular, but without limitation, you agree not to alter or remove any trade marks, copyright or other intellectual property right notice and not to copy, download, transmit, reproduce, print or exploit for commercial purpose any material contained within our Network and/or our Website.
Confidentiality
Other than personal information which is covered by our Privacy Policy, any material or information which you provide to us or transmit or post to our Website shall be considered non-confidential and non proprietary.
Whilst we will use reasonable endeavours to ensure the security of our Network, you acknowledge and agree that the internet is not a secure form of communication and no on-line system is impenetrable. We therefore cannot guarantee the security of your personal and confidential information on-line.

Our Website may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.
Severance
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
Governing Law and Jurisdiction
These Terms and Conditions will be governed by Scottish Law and you hereby agree to submit to the exclusive jurisdiction of the Scottish Courts without reference to rules governing choice of laws.
